1. Acceptance of Terms
Welcome to MovR, operated by Leap24 Technologies (Pty) Ltd ("Company," "we," "us," "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and MovR governing your use of our goods transportation platform, mobile application, website, and related services.
By accessing or using MovR services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access or use our services.
These Terms apply to all users of MovR, including customers requesting transportation services ("Customers") and independent contractors providing transportation services ("Drivers").
2. Description of Service
MovR provides a digital platform that connects Customers with Drivers for goods transportation services within South Africa. Our services include:
- Platform Access: Mobile application and website for requesting and providing transportation services
- Matching Service: Connecting Customers with available Drivers based on location, vehicle type, and service requirements
- Payment Processing: Secure payment systems for transaction handling
- Communication Tools: In-app messaging and calling features
- Tracking and Navigation: Real-time location tracking and route optimization
- Support Services: Customer service, dispute resolution, and technical support
Important: MovR is a technology platform that facilitates connections between Customers and independent Drivers. We are not a transportation company and do not provide transportation services directly.
3. Eligibility and Registration
3.1 General Eligibility
To use MovR services, you must:
- Be at least 18 years old
- Have the legal capacity to enter into contracts
- Reside in or operate within South Africa
- Provide accurate and complete registration information
- Maintain updated account information
3.2 Account Registration
Account registration requires:
- Valid email address and phone number
- Identity verification documents
- Acceptance of these Terms and Privacy Policy
- Compliance with all applicable laws and regulations
3.3 Driver Additional Requirements
Drivers must additionally:
- Hold a valid South African driver's license
- Provide vehicle registration and insurance documentation
- Pass background checks and verification processes
- Maintain required insurance coverage
- Comply with all transportation and safety regulations
4. User Responsibilities
4.1 Account Security
- Maintain confidentiality of login credentials
- Immediately notify us of any unauthorized account access
- Take responsibility for all activities under your account
- Use strong, unique passwords
4.2 Accurate Information
- Provide truthful and accurate information
- Update information promptly when changes occur
- Ensure contact information is current and functional
4.3 Lawful Use
- Comply with all applicable laws and regulations
- Use services only for lawful purposes
- Respect the rights and safety of other users
- Follow community guidelines and platform policies
5. Driver-Specific Terms
5.1 Independent Contractor Status
Drivers are independent contractors and not employees, agents, or representatives of MovR. This relationship means:
- Drivers control their own schedules and work hours
- Drivers are responsible for their own taxes and business expenses
- No employment benefits or protections apply
- Drivers must maintain their own business licenses and permits
5.2 Service Standards
Drivers must:
- Provide professional and courteous service
- Maintain vehicles in safe and clean condition
- Arrive punctually for scheduled pickups
- Handle goods with care and responsibility
- Follow customer instructions and delivery requirements
- Maintain minimum rating standards
5.3 Vehicle and Equipment Requirements
- Maintain valid vehicle registration and roadworthy certificates
- Carry comprehensive vehicle insurance
- Ensure vehicles meet safety and capacity requirements
- Provide necessary equipment for goods handling
6. Payment Terms
6.1 Service Fees
MovR charges service fees calculated based on:
- Distance traveled
- Vehicle type and capacity
- Time duration
- Additional services requested
- Market demand and pricing algorithms
6.2 Payment Processing
- Payments processed through secure third-party providers
- Multiple payment methods accepted
- Automatic payment upon trip completion
- Transaction fees may apply
6.3 Driver Payments
- Drivers receive majority of fare after MovR commission
- Weekly payment processing to driver accounts
- Detailed earnings statements provided
- Drivers responsible for their own tax obligations

7. Insurance and Liability
7.1 Driver Insurance Requirements
All Drivers must maintain:
- Comprehensive motor vehicle insurance
- Goods-in-transit insurance for transported items
- Public liability insurance (minimum R1 million)
- Valid insurance certificates on file with MovR
7.2 Platform Insurance
MovR provides supplementary insurance coverage during active trips:
- Third-party liability coverage
- Goods damage protection (terms and conditions apply)
- Coverage subject to policy terms and exclusions
7.3 Limitation of MovR Liability
MovR's liability is limited to the maximum extent permitted by law. We are not liable for damages, losses, or injuries arising from transportation services provided by independent Drivers.
8. Prohibited Conduct
Users must not engage in any of the following prohibited activities:
8.1 Platform Misuse
- Creating false or misleading accounts
- Circumventing platform fees or payment systems
- Using automated systems to access the platform
- Reverse engineering or attempting to access source code
8.2 Illegal or Harmful Activities
- Transporting illegal or prohibited items
- Using services for money laundering or fraud
- Harassment, discrimination, or abusive behavior
- Violating any applicable laws or regulations
8.3 Safety Violations
- Operating vehicles while impaired
- Exceeding vehicle capacity or weight limits
- Failing to secure transported goods properly
- Ignoring safety protocols and procedures
9. Intellectual Property
All intellectual property rights in MovR's platform, including but not limited to:
- Software, applications, and algorithms
- Trademarks, logos, and branding
- Content, text, images, and graphics
- User interfaces and design elements
Are owned by MovR or our licensors. Users are granted a limited, non-exclusive, non-transferable license to use the platform solely for its intended purposes.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using MovR services, you consent to:
- Collection and processing of personal information as described in our Privacy Policy
- Sharing of necessary information with Drivers and Customers to facilitate services
- Use of location data for service provision and safety purposes
- Communication via email, SMS, and in-app messaging
11. Dispute Resolution
11.1 Internal Resolution
We encourage users to resolve disputes directly through our platform's communication tools and support systems. MovR provides:
- 24/7 customer support
- Dispute mediation services
- Resolution procedures for common issues
- Refund and compensation policies
11.2 Formal Dispute Process
For unresolved disputes:
- Submit written complaint to support@movr.co.za
- Allow 14 days for investigation and response
- Escalate to management if necessary
- Consider alternative dispute resolution
11.3 Legal Action
Any legal disputes shall be subject to the exclusive jurisdiction of South African courts, with proceedings conducted in Cape Town, Western Cape.
12. Limitation of Liability
IMPORTANT LIMITATION: MovR's total liability for any claims arising from or related to the services is limited to the amount paid by you for the specific service giving rise to the claim.
12.1 Exclusions
MovR is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages caused by third parties, including Drivers
- Force majeure events beyond our reasonable control
- User's failure to follow platform guidelines
12.2 User Acknowledgment
Users acknowledge that:
- Transportation services are provided by independent Drivers
- MovR does not guarantee service availability or quality
- Users assume risks associated with goods transportation
- Platform technology may experience interruptions or errors
13. Termination
13.1 Termination by Users
Users may terminate their accounts at any time by:
- Deleting the account through app settings
- Contacting customer support
- Providing written notice of termination
13.2 Termination by MovR
We may suspend or terminate accounts for:
- Violation of these Terms or community guidelines
- Fraudulent or illegal activities
- Safety violations or risk to other users
- Failure to maintain required qualifications (Drivers)
- Inactivity for extended periods
13.3 Effects of Termination
Upon termination:
- Access to platform services ceases immediately
- Outstanding payments will be processed
- Data may be retained as required by law
- Certain provisions of these Terms survive termination
14. Changes to Terms
MovR reserves the right to modify these Terms at any time. When material changes are made:
- Users will be notified via app notification or email
- Updated Terms will be posted with revision date
- Users have 30 days to review changes
- Continued use constitutes acceptance of new Terms
Users who disagree with updated Terms may terminate their accounts as described in Section 13.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of South Africa, including but not limited to:
- Consumer Protection Act
- Protection of Personal Information Act (POPIA)
- Electronic Communications and Transactions Act
- National Road Traffic Act
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of South African courts.
